Real Estate Closings:
We have an extensive real estate closing practice with a combined closing experience of thousands of commercial and residential real estate transactions. From small HELOC loans to jumbo residential loans to the cross-collateralization of million dollar development transactions and private money loans, we have the knowledge and experience to close every deal with no waiting lines or borrower’s frustration. Our loan closings are spaced out so to provide each client the time and patience for a comfortable and rewarding closing experience.
Commercial Closing:
In addition to the services provided for residential closings, we provide due diligence examination of county zoning, building permits, property history, code compliance, survey, environmental, and other services in anticipation of a commercial loan closing. Although the scope of the work is typically determined by the lender, we undertake minimum requirements to ensure title is good for closing.
Private Money:
In Georgia, you can count on your hand the amount of active private money lenders. Our office is one of very few firms that maintain the knowledge to set up these complicated deals between lenders and their borrowers and how to securitize these transactions with investors’ funds. We prepare the servicing packages between principals and investors and coordinate the proper recording and escrowing of various documents that supplement the servicing portion of investor’s capital. We further act as the legal liaison for the parties and coordinate the payoff, cancellation and satisfaction of private loans.
Residential Closing:
Our residential closing starts off with a title request for a full title examination. We check title for 50 years in the chain and determine that all links to the chain are accounted for with no gaps or discrepancies. Depending on the lender, surveys are usually accounted for under an endorsement subject to approval by the title company. We coordinate the payoffs and insurance declaration page from the parties/agents available and work a loan commitment to the lender along with our wiring instructions, real estate tax information, fee schedule, and closing protection letter. These items are sent as a “One Shot” package so to insure that the lender received all of our information at one time. Our closing schedule is flexible and we work around the borrower’s availability.
Title Examination and Insurance Services:
Our office provides with full and limited title examinations in the entire State of Georgia. Our examinations are prepared via title commitments, title opinion or abstract form. Our titles are also fully insured by various title insurance companies such as First American Title Insurance Company and Attorney’s Title Guaranty Fund. We are proficient in clearing up title defects, and have mastered creative ways to clean up title in a time effective manner.
Foreclosures:
We handle all aspects of loan foreclosure sales. From the initial notices of default to the loan acceleration, from the foreclosure publication to crying the sale, we make sure that your security remains intact. At the same time, we work with borrowers and attempt to mitigate their default by securing additional collateral, reinstatement fees and other penalties that will provide borrowers with time to secure financing while balancing investor’s interest with additional security. More often that not, we are able to find a solution to avoid foreclosure afford investor(s) with a business solution short of foreclosure.
